Who Is liable for a Car/Motorcycle Accident in Colorado?

“Preponderance of the evidence”, means that the other person is 51% or greater responsible for the crash. If your fault is found to be 51% or greater, then you can be barred from seeking any damages from the other parties involved. In some accidents, the evidence is clear as to who was at fault. But others are not.

What to do after a Car Accident in Colorado
You have just been in an accident. Your mind is going in 10 different directions. Your adrenaline is pumping throughout your body. Most of the time if it is not too serious of an accident, you don’t feel pain right away.
When injuries occur, follow these basic steps so your right to full compensation is protected (if you are able):
- Check Yourself and Others for Injuries. Check on yourself, your passengers, and, if possible, on the occupants of other cars involved in the accident. Assess whether people are in pain, if they are bleeding, if they hit their heads or are unconscious, and if they are breathing. If you know CPR and someone needs it, now is the time to use those skills. Make sure that you are not hurt yourself before you try it, though.
- Call 911. Make sure to call 911 so emergency medical attention can be given to the injured at the scene. DO NOT ADMIT FAULT to the 911 dispatcher OR EMT’s or Police, since this can be used as evidence in your case.
- Take Photos of the Damages. Get pictures of the damage to your car, both inside and out, as well as photos of any injuries you or your passengers have suffered.
- Get Insurance Information. Get names, addresses, insurance information, and contact information from the other parties involved in the accident. This makes it easier for you and your insurance company to follow up with them later.
- File an Auto Accident Report. DO NOT AGREE WITH THE AT FAULT PARTY TO JUST EXCHANGE INSURANCE INFORMATION. Call the police or arrange to file a police report to document the crash. Do not leave until police arrive. This may be the only way to prove who was at fault. It is mandated by law that an accident involving injuries or property damage be reported to law enforcement.
- Medical. Get medical attention as soon as you feel any pain or discomfort. This is imperative to prove you were injured in the crash. If you do not have medical insurance, we can help you get the medical treatment you need.
